These Terms of Use (“Terms”) govern your access to and use of chrisgallant.ca (the “Site”), including purchases, digital downloads, workshop requests, and other services made available through the Site.

The Site is operated by Chris Gallant Speaking, a sole proprietorship operated by Chris Gallant (“Chris Gallant Speaking,” “we,” “us,” or “our”).

By accessing the Site, placing an order, downloading a product, submitting a workshop request, or otherwise using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

Eligibility

You may use the Site only in compliance with applicable law.

If you have not reached the age of majority where you live, you may make a purchase or use a paid service only with the involvement and permission of a parent or legal guardian.

Teachers, school staff, or other authorized adults should submit school-workshop requests on behalf of schools and student groups.

Website Information

We make reasonable efforts to keep the Site’s information accurate and current. However, occasional errors, omissions, technical problems, or outdated information may occur.

We may correct errors, update information, change content, suspend features, or discontinue portions of the Site at any time. This includes correcting product descriptions, pricing, availability, promotions, and other information.

Images and mockups are provided to help illustrate products. The appearance of colours may vary depending on your screen, device, print process, paper, and lighting. Minor colour or positioning differences that do not materially affect the product are not considered defects.

Intellectual Property

Unless otherwise stated, the Site and its contents are owned by or appropriately licensed to Chris Gallant Speaking.

Protected content may include:

  • Poems and written works;

  • Books and excerpts;

  • Audio recordings and performances;

  • Videos;

  • Photographs and artwork;

  • Poetry-print designs;

  • Logos and branding;

  • Workshop materials;

  • Graphics and product images;

  • Website copy and layout; and

  • Other original materials.

You may view the Site and share links to its publicly available pages for personal, non-commercial purposes.

Except where these Terms or written permission expressly allow it, you may not:

  • Copy, reproduce, republish, distribute, or publicly display Site content;

  • Record, download, or redistribute audio or video content;

  • Remove copyright, trademark, or attribution notices;

  • Sell, license, or commercially exploit Site content;

  • Use poems, designs, recordings, or workshop materials to create derivative products;

  • Upload or distribute purchased digital files;

  • Use Site content to train, develop, or supply an artificial-intelligence system or dataset; or

  • Suggest that Chris Gallant Speaking endorses you, your organization, or your products.

All rights not expressly granted are reserved.

Physical Products

Physical poetry prints and other merchandise sold through the Site may be produced and fulfilled on demand by Printful or another fulfilment provider.

Product descriptions identify relevant details such as available sizes, materials, pricing, and whether a frame or other accessory is included. Unless a product listing expressly says otherwise, frames are not included with poetry prints.

Because products are made to order, availability and fulfilment times may change.

Orders

Submitting an order is an offer to purchase the selected products. An automated order acknowledgement does not guarantee that an order has been accepted or can be fulfilled.

We may refuse or cancel an order where reasonably necessary, including because of:

  • Incorrect pricing or product information;

  • Suspected fraud or unauthorized payment;

  • Product or fulfilment unavailability;

  • A technical error;

  • Shipping restrictions;

  • An obviously incorrect or incomplete address; or

  • A violation of these Terms.

If we cancel an order after payment has been successfully processed, we will refund the applicable amount to the original payment method.

You are responsible for reviewing product selections, sizes, quantities, shipping details, and contact information before completing checkout.

Prices, Currency, Taxes, and Payment

Unless otherwise stated, prices displayed on the Site are in Canadian dollars.

Applicable taxes are calculated and added during checkout. Physical-product shipping is included in the displayed price where free shipping is offered.

International customers are responsible for customs duties, import taxes, brokerage fees, handling charges, or other government or carrier charges that may apply in the destination country. These charges may not be known or collected by us during checkout.

Online payments are processed through Stripe. Your use of Stripe’s payment services is also subject to Stripe’s applicable terms and privacy practices.

We may change prices at any time. Price changes do not normally affect orders that we have already accepted, except where correction is permitted or required by law.

Shipping and Delivery

We offer shipping to destinations supported by our fulfilment providers and displayed as available during checkout.

Delivery dates and transit times are estimates, not guarantees. Production or delivery may be affected by:

  • Carrier delays;

  • Customs processing;

  • Weather;

  • Labour disruptions;

  • Holiday demand;

  • Incorrect or incomplete addresses;

  • Failed delivery attempts;

  • Events beyond our reasonable control; or

  • Other logistical or technical issues.

A delay does not automatically entitle a customer to a refund, except where required by applicable consumer-protection law.

Customers are responsible for providing a complete and accurate delivery address. If an order is returned, lost, or undeliverable because the customer supplied an incorrect or incomplete address, the customer may be responsible for the cost of reshipping or replacing the order.

Please contact us promptly if you notice an address error. We cannot guarantee that an address can be changed after fulfilment has begun.

Order Changes and Cancellations

If you need to change or cancel a physical-product order, contact chris@chrisgallant.ca immediately.

We may be able to change or cancel an order before Printful or another fulfilment provider begins production. Once production or fulfilment has begun, the order normally cannot be changed or cancelled.

Nothing in this section limits a cancellation right that cannot legally be waived.

Final-Sale and Return Policy

Because physical products are made to order, all physical-product sales are final except where:

  • The product arrives damaged;

  • The product is defective;

  • The product is misprinted;

  • The product is materially different from what was ordered;

  • The package is confirmed lost in transit; or

  • A return, refund, replacement, or cancellation is required by law.

We do not normally offer returns, exchanges, replacements, or refunds because:

  • The customer changed their mind;

  • The customer ordered the wrong size or product;

  • The customer supplied an incorrect or incomplete address;

  • The customer no longer wants the product;

  • The recipient refuses or fails to collect the delivery; or

  • The printed product has a minor colour difference from its on-screen appearance.

Damaged, Defective, Misprinted, or Incorrect Products

If a physical product arrives damaged, defective, misprinted, or materially incorrect, contact chris@chrisgallant.cawithin 30 days after receiving it.

Please include:

  • Your name;

  • Order number;

  • A description of the problem;

  • Clear photographs showing the entire product; and

  • Close-up photographs showing the damage, defect, or printing error.

We may request additional information reasonably needed to evaluate the claim.

Where a claim is valid, we may provide an appropriate replacement or refund. A return may not be required unless we provide instructions stating otherwise.

Normal variation in colour, placement, texture, or appearance that results from screens, print processes, paper, or lighting is not normally considered a defect.

Packages Lost in Transit

If an order has not arrived and appears to be lost, contact us no later than 30 days after the estimated delivery date.

We may ask you to confirm the shipping address, check with household members or neighbours, contact the carrier, or complete other reasonable steps before we submit or approve a claim.

Where the carrier or fulfilment provider confirms that a qualifying package was lost in transit, we may arrange a replacement or refund.

Packages delivered to the address supplied at checkout, returned because of an incorrect address, or left unclaimed may not qualify as lost shipments.

Consumer Rights

These Terms do not exclude, restrict, or replace any warranty, cancellation right, refund right, remedy, or other consumer protection that cannot legally be waived.

Where applicable law conflicts with these Terms, the mandatory legal requirement will apply.

Digital Products

The Site may offer downloadable poetry prints or other digital products.

Unless otherwise required by law, digital-product sales are final once the download or access has been supplied. Customers are responsible for confirming that their devices, software, and chosen print method can use the file format and dimensions described in the product listing.

Purchasing a digital product grants you a limited, revocable, non-exclusive, non-transferable licence for personal, non-commercial use.

You may:

  • Download the purchased file to your personal devices;

  • Create a reasonable number of printed copies for your own personal or household use; and

  • Provide the file to a printing service solely to produce permitted personal copies for you.

You may not:

  • Sell or redistribute the digital file;

  • Share it with others;

  • Upload it to a public or shared platform;

  • Resell physical copies;

  • Use it for business, advertising, merchandise, fundraising, or commercial purposes;

  • Modify it to create another product;

  • Remove copyright or attribution information;

  • Claim the work as your own; or

  • Permit a printing provider to retain, reproduce, sell, or distribute it for any other purpose.

Purchasing a digital product transfers no copyright or ownership interest in the underlying poem, design, artwork, or file.

Books, Audio, and Third-Party Retailers

The Site may link to books, audiobooks, audio programs, streaming services, and other products offered through external platforms such as Amazon, Indigo, Barnes & Noble, Spotify, Apple Books, Audible, Vimeo, or other providers.

Unless the Site expressly states otherwise, transactions and access through those platforms occur between you and the external provider. Their pricing, availability, payments, subscriptions, refunds, delivery, accessibility, regional restrictions, privacy practices, and terms apply.

We are not responsible for an external provider’s website, checkout, technical performance, catalogue availability, account requirements, or customer service.

Links are provided for convenience and do not necessarily constitute an endorsement of every product, service, statement, or practice of the external provider.

School Workshops

Information about school workshops is provided for general planning and promotional purposes.

Submitting a workshop-request form is an inquiry only. It does not create a confirmed booking, reserve a date, or require either party to proceed.

A workshop becomes confirmed only after the school or client and Chris Gallant Speaking agree to the relevant arrangements and written confirmation is provided.

Final terms concerning workshop pricing, taxes, dates, payment, cancellation, rescheduling, travel, school responsibilities, book orders, and other arrangements may be included in a written booking confirmation, proposal, agreement, or invoice.

Those specific written terms form part of the workshop agreement. If they conflict with general workshop information on the Site, the specific written booking terms will govern.

Current standard booking terms may include:

  • Cancellation at least three days before the scheduled workshop without penalty;

  • A possible fee of 20% for cancellation within three days, unless the workshop is rescheduled;

  • A reschedule or refund of amounts paid if Chris Gallant Speaking cancels;

  • Payment due within two weeks of the workshop; and

  • Payment for book orders even if the associated workshop is cancelled.

The specific terms provided for a booking will control and may be updated by written agreement.

Workshop Materials

Teachers and participating schools may use workshop materials that we intentionally provide for their own classroom or internal educational purposes.

Unless written permission states otherwise, this permission does not allow materials to be:

  • Sold or sublicensed;

  • Published online;

  • Distributed publicly;

  • Used in a commercial program;

  • Presented as the recipient’s original work; or

  • Modified and redistributed as a new product.

Copyright and attribution notices must remain intact.

Promotions and Limited Releases

We may offer discount codes, limited-time products, seasonal collections, product drops, bundles, or other promotions.

We may establish eligibility requirements, quantities, expiry dates, geographic restrictions, and other promotion-specific terms. Promotions may be changed, suspended, or ended where reasonably necessary, subject to existing accepted orders and applicable law.

Discounts cannot be combined unless expressly stated. Discount codes have no cash value and may not be sold or transferred unless their terms allow it.

Products offered through a limited release may become unavailable without notice.

Email Communications

If you voluntarily subscribe to the email list, you agree to receive the types of communications described on the signup form.

You may unsubscribe at any time using the unsubscribe link included in an email. Transactional communications concerning purchases, workshop requests, customer service, or other existing business matters are separate from marketing subscriptions.

Our handling of email addresses and other personal information is described in our Privacy Policy.

Acceptable Use

You agree not to:

  • Use the Site for an unlawful, fraudulent, or abusive purpose;

  • Attempt to gain unauthorized access to the Site, its accounts, systems, or data;

  • Introduce malware, harmful code, or disruptive technology;

  • Scrape, harvest, or systematically extract Site content or personal information;

  • Interfere with the Site’s operation or security;

  • Misrepresent your identity or authority;

  • Submit false payment, delivery, or booking information;

  • Infringe intellectual-property or privacy rights; or

  • Use the Site in a way that could harm Chris Gallant Speaking or another person.

We may restrict access, cancel an affected order, or take other reasonable action in response to suspected misuse.

External Links and Services

The Site may contain links to or integrations with third-party websites and services.

We do not control and are not responsible for third-party content, availability, security, privacy, or business practices. You access external services at your own discretion and subject to their terms.

Privacy

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy. The Privacy Policy forms part of these Terms where applicable.

Site Availability and Security

We aim to keep the Site available and secure, but we do not guarantee uninterrupted, error-free, or completely secure access.

We may temporarily restrict or suspend access for maintenance, updates, security work, technical issues, or circumstances outside our reasonable control.

Disclaimers

To the extent permitted by law, the Site and its general informational content are provided on an “as available” basis.

We do not guarantee that:

  • The Site will always be available or free from errors;

  • Every error will be corrected immediately;

  • General website information will be suitable for every purpose; or

  • Third-party links, platforms, or services will remain available.

Nothing on the Site constitutes medical, mental-health, legal, financial, or other regulated professional advice.

Any disclaimer in these Terms applies only to the extent permitted by law and does not limit mandatory consumer protections.

Limitation of Liability

To the extent permitted by applicable law, Chris Gallant Speaking and Chris Gallant will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the use of, or inability to use, the Site.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising from fraud, wilful misconduct, or any consumer right that cannot be waived.

Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses resulting from your unlawful use of the Site, infringement of another person’s rights, or material violation of these Terms.

This provision does not apply to losses caused by our own unlawful conduct and does not limit any non-waivable consumer right.

Changes to These Terms

We may update these Terms to reflect changes to the Site, products, services, business practices, or legal requirements.

The revised Terms will be posted on this page with an updated effective date. Changes apply prospectively unless applicable law permits or requires otherwise.

Terms applicable to an accepted order or confirmed workshop booking will not normally be changed retroactively without agreement or legal authority.

Governing Law and Jurisdiction

These Terms are governed by the laws of Nova Scotia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any consumer right that allows otherwise, disputes relating to these Terms or the Site will be brought before the courts of Nova Scotia, Canada.

Severability

If a provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

No Waiver

A failure or delay in enforcing a provision of these Terms does not waive the right to enforce it later.

Entire Agreement

These Terms, the Privacy Policy, applicable product information, checkout disclosures, and any specific written workshop agreement constitute the applicable agreement between you and Chris Gallant Speaking concerning the relevant use, purchase, or service.
